Section 24
Offenses and Punishment
: (1) If someone is negligent in causing a disaster or is directly involved in reducing such an event, such person shall be punished with a fine up to five lakh rupees or imprisonment for a term of up to two years or both according to the amount of the offence.
(2) If any person commits any of the following acts, such person shall be punished with a fine up to one lakh rupees or imprisonment for a term up to six months or both according to the amount of the offence:-
(a) If a public panic is created by spreading a rumor that a calamity may occur,
(b) collecting donations, relief or assistance in the name of calamity with or without permission, voluntarily distributing them or using them for personal gain,
(c) If the market price is increased unnaturally during the calamity or artificial scarcity is created or if goods and services of poor quality are traded.
(3) Notwithstanding anything written in sub-section (1), if any person is killed, maimed or injured due to committing an offense under that sub-section, the person who commits such act shall be punished according to the prevailing law.
(4) If someone commits the following acts, such person will be fined up to fifty thousand rupees:-
(a) If the Government of Nepal, Council, Authority or any committee constituted under this Act or any person authorized to perform any work under this Act is obstructed from fulfilling their duties,
(b) Failure to comply with orders or directions issued in connection with the execution of this Act,
(c) In case of obstructing the distribution of relief materials or misusing the relief materials,
(d) If doing any act contrary to this Act and the rules under this Act other than those mentioned in sub-section (1), (2) and (3).
(5) If any organized organization commits an act contrary to this Act, the person of such organization involved in such act and if such person is not certain, the person acting as the head of that organization shall be punished according to this section.
