Section 9
Not to be refused admission

(1) If a parent requests to enroll his child in a school suitable for him or in any other school to get education up to the basic level, the headmaster of such school should not refuse to enroll him except in the following cases:-
(a) If the number of children enrolled for a class is equal to the number of students to be taught, (b) if he does not meet the minimum standards of the class in which he intends to be admitted,
(c)   If additional children cannot be admitted due to the physical condition of the school.
(2) Irrespective of what is written in clauses (a), (b) and (c) of sub-section (1), disabled or economically disadvantaged children should be admitted by their own schools.
(3) In case of refusal to admit children according to sub-section (1), the concerned headmaster shall recommend that the concerned children be admitted to such school if there is any other suitable school near such school.
(4) If a child cannot be admitted in accordance with sub-section (3), the reason shall be given in writing to the parents and the relevant ward office shall be informed and such office shall facilitate the enrollment of such children in schools located within the respective ward or elsewhere.
(5) If it is not possible to enroll in the case of clause (b) of sub-section (1), he should be admitted to the same school in the same class if his parents want him to complete the level of the basic level.
(6) Refusal to admit a child except as provided in this section shall be punishable.
