Section 19
Unqualified
(1) Regardless of what is written in the existing law, for the purpose of creating an environment in which all citizens get basic education compulsorily, a person who has not received basic education after the 1st of Baisakh, 2085 shall not be considered eligible to receive any of the following opportunities:-
(a) to enter into any government service of the Government of Nepal, State Government or local level or to enter into the service of any institution wholly or partly owned, subsidized or controlled by the Government of Nepal, State Government or local level or established in any governmental, non-governmental or private sector; To be elected, appointed or nominated to any post in the organization or to obtain any employment,
(b) to establish any company, firm, co-operative society or non-governmental organization or to be a founder shareholder, director or member or any officer of such company firm or organization,
(2) Notwithstanding anything contained in sub-section (1), a person who has attained the age of twelve years before the commencement of the provisions of sub-section (1) or has been appointed, elected, nominated or appointed to any position or is employed or has received or enjoyed benefits In that case, nothing written in that sub-section will have any effect.
(3) Notwithstanding anything contained in sub-section (1), this sub-section shall not apply to a person who is unable to receive education because of poor health or multiple disabilities or any other such complex reason.
