Section 63
Court fees charged
(1) A court fee will be charged when filing a petition or appeal in court or taking any counterclaim in court.
(2) Except as stated in sub-section (1), court fees shall be paid in case of an order not to review or to repeat a case in an application for reconsideration or repetition of a case. Explanation: For the purpose of this paragraph, "court fee" means the fee charged when a petition or appeal is filed or when a case is reviewed or repeated. Fees should be understood and that term also refers to the fees paid by the counterclaimee for taking the counterclaim.
(3) Notwithstanding anything written in sub-section (1) or (2), no court fee shall be charged in accordance with this paragraph in the case of a case in which the Government of Nepal, provincial government or local level is the plaintiff, or in the case of a case in which the Government of Nepal publishes a notice in the Nepal Gazette and takes action by the designated body.
