Rule 16
Sale or distribution of land for Mohiani rights in excess of the maximum limit
:
(1) As much of the land that has Mohiani rights obtained by evicting the person convicted as per Section 11, Sub-section (1) of the Act, shall be divided as per the provisions of the Act and as much land as the separate Mohi portion and the land acquired as per Rule 14 due to Mohiani rights, the land reform officer of the Act Sale will be distributed under section 21. 2) In relation to the land acquired and sold in accordance with sub-rule (1), if the government of Nepal has decided to give the compensation to the previous owner in accordance with rule 15, then the person who receives such land acquired in accordance with rule 14 in the sale and distribution according to sub-rule (1) shall receive the amount determined in accordance with rule 15 as a lump sum. or within five annual installments in cash to the District Land Reforms Officer or to the place designated by him for that purpose. Those who pay in installments will be charged interest at the rate of ten percent per annum for the period of payment. However, the provision will not be applicable in the case of Mohi whose land revenue is more than the maximum limit.
(3) The installment amount as per sub-rule (2) should be paid by the end of January of every year. However, if someone wants to pay the full amount or one or more installments or any part of it before the due date, he can pay it.
(4) The District Land Reforms Officer should open a separate account in the bank and deposit the amount to be collected according to this rule.
(5) If someone fails to pay the amount of any installment to be paid in accordance with this rule within the deadline, he will be evicted from the land concerned by the order of the District Land Reforms Officer and sold and distributed to other persons in accordance with these rules.
(6) According to sub-rule (1), the land reform officer will issue a certificate in the format as per schedule-5 to the person who will get the land sale and distribution.
(7) According to this rule, the registration book of the land that has been sold and distributed shall be kept in the format as per Schedule-18 and a copy of the same shall be sent to the Land Registry Office to cancel the filing in the name of the person entitled to the sale and distribution.
