Section 52
<br> who can apply to the district court to enforce the rights
Notwithstanding anything written in section 51, a person with a disability, his family member or guardian may directly apply before the district court of the district where the person with a disability resides to enforce the rights of the person with a disability or to fulfill his obligations towards him.
(2) If an application is received in accordance with sub-section (1), the district court may issue an appropriate order in the name of the concerned person or entity regarding the implementation of the rights of the disabled person or the fulfillment of the obligations towards the disabled person after conducting the necessary investigation.
(3) If it appears that any family member or custodian has violated the rights of a person with a disability or has not fulfilled his obligations towards a person with a disability while examining the application received under sub-section (1), the court shall inform such family member or the custodian about the rights of the person with a disability and the responsibilities towards him. It should be made to express a commitment not to violate the rights of persons with disabilities or to fulfill their obligations towards them.
(4) When issuing an order in accordance with sub-section (2), the district court may warn the head of the person, organization or body that violates the rights of the disabled person or does not fulfill its obligations towards the disabled person or punish him in accordance with section 55 and order him to pay reasonable compensation.
