(1) After the recommendation of the Council of Ministers to issue an ordinance in accordance with Article 114 of the Constitution of Nepal, the Ministry of Law, Justice and Parliamentary Affairs shall prepare three copies of the draft of such ordinance on Nepalese paper.
(2) The draft of the ordinance prepared in accordance with sub-section (1) shall be signed by the following officers:-
(a) The Prime Minister,
(b) Departmental Minister concerned,
(c) Minister of Law, Justice and Constituent Assembly Order,
(d) Chief Secretary to the Government of Nepal, and
(e) Secretary of the Ministry of Law, Justice and Constituent Assembly.
(3) The draft of the ordinance signed in accordance with sub-section (2) shall be sent by the Ministry of Law, Justice and Constituent Assembly to the Office of the Prime Minister and the Council of Ministers and the Office of the Prime Minister and the Council of Ministers shall submit such draft to the President for verification.
(4) The ordinance shall be authenticated after the President mentions the date and signs the copies of the draft ordinance received according to sub-section (3).
(5) After the verification in accordance with sub-section (4), the Ordinance shall be enforced as an Act.
(6) After the ordinance is certified according to sub-section (4), one copy of such authentic copies shall be kept in the office of the President and one copy each shall be sent to the office of the Prime Minister and the Council of Ministers and the Ministry of Law, Justice and Constituent Assembly Order and each such office shall keep the authentic copy so received safely. .
(7) Based on the authentic copy received as per subsection (6), the secretary of the Ministry of Law, Justice and Constituent Assembly shall publish the ordinance in the Nepal Gazette keeping the date of certification of the ordinance.
