(1) According to sub-section (1) of section 23 of the Act, a person who has capital, technical expertise and professional competence as per rule 8 who wants to operate a telecommunication service shall operate within the time limit mentioned in the public notice published by the authority in accordance with sub-section (1) of section 22 of the Act. An application should be submitted to the Authority in the format as per Schedule-1, including the economic and technical study report and operational plan related to the desired telecommunication service, along with the matters mentioned in that notice.
(2) Notwithstanding anything written in sub-rule (1), in accordance with sub-section (2) of section 23 of the Act, an application may be submitted to the authority at any time in the format as per Schedule-1 for obtaining a license to operate a telecommunication service prescribed by the Government of Nepal by publishing a notice in the Nepal Gazette.
(3) According to sub-section (3) of Section 23 of the Act, before the commencement of the Act, a person who is operating a telecommunication service after obtaining a license from the Government of Nepal shall submit an application to the authority in the format of Schedule (2) within six months from the date of commencement of the Act.
