Section 193
Provisions relating to intercountry adoption or adoption boards

(1) In accordance with this paragraph, the Government of Nepal may publish a notice in the Nepal Gazette to act as a central body for the purpose of recommending permission to adopt a foreign child as an adopted child or adoptive daughter or may appoint a government body to do such work. Explanation : For the purpose of this paragraph, "Board" means Intercountry Adoption or Adoption Board and the term also refers to the government body appointed to do such work.
(2) When forming the board as per sub-section (1), it shall be constituted in such a way that one child rights worker who has worked in the field of child rights for at least fifteen years should be included.
(3) In addition to the functions, duties and powers written elsewhere in this paragraph, other functions, duties and powers of the Board shall be as follows:-
(a) Making a policy on intercountry adoption or adoption-related issues and recommending to the Government of Nepal,
(b) Co-ordinating between various agencies on inter-country adoption or adoption-related matters,
(c) Preventing unfair financial and other benefits that may be obtained from adoption or adoption,
(d) To provide any information about the status of the adopted son or adopted daughter upon request by the central body or other related public body related to the adopted son or daughter of other countries,
(e) To protect Nepali children from child abuse, exploitation, trafficking or kidnapping, trafficking and any other practices that may harm children, which may occur while adopting or giving adopted children,
(f) Recommending to the Government of Nepal to determine the fees for adopting a son or daughter-in-law (g) prescribing the form of application to be made for adopting a son or daughter-in-law,
(h) To make arrangements to keep confidential the record of the minor who wishes to live as an adopted son or adopted daughter, the father and mother who gave birth to him or the father and mother of the adopted son or daughter,
(i) Intercountry adoption or other necessary actions related to adoption.
(4) The board office shall determine other procedures related to the work of the board, including the board meeting.
