Section 4
Disability Identity Card Provisions
(1) A person with a disability must submit an application to the local level along with the recommendation of the concerned ward local level by him/herself or any member of his/her family or guardian to obtain a disability identification card.
(2) Notwithstanding anything written in sub-section (1), if a disabled person is unable to apply by himself or if there is no member of his family or a guardian, the ward chairman of the relevant ward of the local level may apply for a disability identity card on his behalf as per sub-section (1) .
(3) After receiving the application according to sub-section (1) or (2), the office will carry out the necessary investigation on the said application and in the case of a person who clearly appears to have a disability, the classification of the disability must also be mentioned and a disability identification card must be issued in the prescribed format.
(4) In the case of a person who is not clear as to which classification of disability falls under subsection (3) when examining the application, or who is in doubt about whether or not he has a disability, the office shall submit it to the coordination committee and based on the recommendation of that committee, issue a disability identification card in accordance with subsection (3).
(5) If the coordinating committee deems it necessary to conduct a physical examination of a person who has received a disability identification card before making a recommendation in accordance with sub-section (4), the health examination shall be conducted at the nearest government hospital at the expense of the office.
(6) According to this section, if a person cannot be given a disability identification card during the examination or physical examination, the office shall provide the applicant with the reason.
(7) According to sub-section (6), a person who is not satisfied with the decision made by the office to refuse to issue a disability identification card may file a complaint with the Ministry or an official designated by the Ministry within thirty-five days, and the decision made by the Ministry regarding such complaint shall be final.
(8) Other provisions related to the issuance of identity cards to persons with disabilities shall be as prescribed.
