Rule 41C
Location and area of ​​land to be provided to squatters:

(1) According to Section 52C of the Act, the Commission may provide the family of an unorganized resident with a maximum area of ​​the following area for housing or agricultural purposes in the place where he is occupying the land: (a) For housing purposes:
(1) One hundred and thirty square meters in the urban area of ​​Kathmandu Valley and Metropolitan City, Sub-Metropolitan City and Municipal City,
(2) One thousand square meters in areas other than those mentioned in sub-section (1). (b) Ten thousand square meters for agricultural purposes (2) Notwithstanding anything contained in sub-rule (1), in the following cases, the following shall apply:-
(a) Land will not be made available for agricultural purposes in the urban areas of Kathmandu Valley and Metropolitan City, Sub-metropolitan City and Municipality.
(b) In the event that the residence or accommodation is reduced in an area less than the area mentioned in sub-rule (1), such residence or accommodation shall be provided to the land owner to the extent of the reduced area.
(c) Section of the Act. No land shall be provided elsewhere in lieu of the land or the compensation thereof to the resident or the irregular resident who has come to the land mentioned in sub-section (4).
(d) Any irregular resident has built a permanent structure in an area greater than the area mentioned in sub-section (1) of clause (a) of sub-rule (1) and such structure (if not distinguishable from a technical point of view, up to a maximum of forty-six square meters and if the structure has not been built) is matched to other government land bordering on the land of his residence or awad. Also, if landless Dalit squatters are not given enough land according to these rules or if it cannot be used for other government or public purposes, additional land ownership up to forty-six square meters can be provided.
(e) If an unorganized resident resides and resides in separate places of more than one local level bordering each other in the same district, the area mentioned in clause (a) of sub-rule (1) for his residence, includingWithout increasing the area mentioned in clause (b) of the same bye-law, they should live there. For Awad Reduction: Land will be provided. However, an unorganized resident who resides in a local level or more than one district that does not have a border with each other in the same district shall not increase the area mentioned in clause (a) of sub-rule (1) for housing in any single local level or district of his choice, but does not increase the area mentioned in clause (b) of the same sub-rule. Only land up to area will be provided.
(3) Notwithstanding anything else written in this rule, if any land owner who is connected with any government or public land and has encroached upon such government or public land to his land, such land shall not be provided to him.
(4) According to this rule, the land provided for agricultural purposes cannot be used for other purposes except agriculture.
(5) Rule 41ch. According to the order determined by the Commission, the ownership of the land shall be made available to the unorganized resident by increasing the extent of the area as per sub-rule (1).
(6) Regardless of what is written in sub-rule (5), if an economically disadvantaged unorganized resident of the following conditions has made a claim for the area of ​​land as per sub-rule (1) clause (a) and up to fifteen hundred square meters in the case of agriculture, the Commission shall determine according to 41 Ch. Land can be provided for housing or agricultural purposes by taking up to twenty-five percent of the amount due:-
(a) Having no basis or property to support the family members,
(b) The main person or member of the family is physically or mentally disabled and unable to work and the other members of the family also have no source of income, and
(c) There is a situation where support can also be obtained from the person who takes care of the family. Explanation: For the purpose of this rule, "economically disadvantaged" means a person whose income is less than the income prescribed by the Government of Nepal.
(7) Rule 41ch. Pay the dues determined as per lump sum due to financial distressDue to inability, any irregular resident can file an application before the commission.
(8) When investigating the application received according to sub-rule (7), if the reason mentioned in the petition of such a disorderly resident is credible, the Commission may set installments for such disorderly resident to pay the fee within three years.
(9) Until the payment of the dues as per sub-rule (8), the commission has retained the land in the name of the unorganized resident according to the registration list.
(10) After the unorganized resident submits all the documents, the relevant land office will issue the land owner certificate in his name.
