Rule 13
Arrangements regarding authorized representatives

(1) The state of registration, the state of operator, the state of design or the state of manufacturer may appoint and send an official representative in the investigation of an accident that occurred within the territory of Nepal. (2) Notwithstanding anything written in sub-rule (1), any foreign state may, if it wishes, appoint and send its official representative to assist in the investigation of the accident or to provide necessary information, facilities or experts in that regard.
(3) The official representative under sub-rules (1) and (2) shall have the following powers with the permission of the Commission:-
(a) inspecting the accident area,
(b) examining wreckage of crashed aircraft,
(c) receiving information from the witness and suggesting questions to be asked to the witness,
(d) obtaining access to available relevant evidence,
(e) Obtaining copies of required documents,
(f) Reading recorded notices,
(g) Participating in investigation activities outside the accident area such as parts testing, technical presentation (briefing) of the accident and simulation work,
(h) To participate in other work related to accident investigation.
(4) Notwithstanding anything else written in this rule, if a citizen of a foreign state is seriously injured or killed in an accident and such state wishes to be involved in the investigation of the accident, an expert may be appointed.
(5) The expert appointed under sub-rule (4) shall, with the permission of the Commission, have the following powers:--
(a) Inspecting the accident site (B) To receive relevant, factual and other information and information related to the accident (6) The official representative or expert shall make available to the Commission all relevant information received by him.
(7) The official representative or expert shall not publish any information and bring it to discussion without the permission of the Commission.
(8) If an aircraft registered in Nepal has an accident in a foreign country, the Government of Nepal may appoint and send its official representative to investigate the accident. (9) The rights and obligations of the official representative appointed in accordance with sub-rule (8) shall be as determined by the Government of Nepal at the time of his appointment.
