(1) A Water Tariff Determination Commission has been established to protect the interests of consumers by providing quality and reliable water and sanitation services at reasonable prices by determining the tariff for drinking water and sanitation services.
(2) The following members will be in the commission as per sub-section (1):-
(a) A person appointed by the Government of Nepal from among the persons who have obtained at least a bachelor's degree in engineering, management, economics or financial management from a recognized educational institution and who have at least twelve years of experience in taking managerial responsibilities in a public organization - Chairman
(b) One member appointed by the Government of Nepal from among the persons who have obtained at least a bachelor's degree in economics, financial management or analysis, chartered accountancy or commerce from a recognized educational institution and have at least ten years of experience in work related to economic evaluation, accounting or financial analysis. (c) One member appointed by the Government of Nepal from among women, Dalits and tribals who have obtained at least a bachelor's degree in engineering, sociology or law from a recognized educational institution and have at least seven years of experience in the relevant field. (3) The term of office of the chairman and members shall be four years and they may be re-appointed for one more term.
(4) The member shall take oath in the format mentioned in the schedule before assuming his/her duties.
(5) The Chairman shall appoint an authorized employee of the Commission to act as the Secretary of the Commission (6) The chairman or member shall not be removed from his office before the expiry of his term of office.
(7) Notwithstanding anything contained elsewhere in this section, if the chairman or member fails to fulfill his official duties or does not act honestly or if he is in bad conduct, physically or mentally disabled or it is proved that he has a financial interest with the service provider or if he is punished by the court on criminal charges. If found, he can be removed from the position of chairman or member at any time.
(8) Any person aCannot be appointed to the position of chairman or member or remain in office:-
(a) Incumbent employees of the Government of Nepal,
(b) Officials of political parties,
(c) a person working in a service provider or an organization related to a service provider or having an investment in such an organization or having any kind of personal interest in it,
(d) A person who does not have the qualifications and experience as per sub-section (2), and
(e) A person who has completed sixty-five years of age.
