Section 28
Secretary of the Commission
(1) There shall be a Secretary to act as the Administrative Head of the Commission.
(2) The appointment of the Secretary shall be made by the Government of Nepal on the recommendation of the Commission.
(3) The qualifications, remuneration, facilities and other conditions of service of the Secretary shall be the same as those of the gazetted special category employees of the Government of Nepal.
(4) The secretary will work under the general direction of the chairman (5) In addition to the duties and powers specified in this Act and other prevailing laws, the other duties, duties and powers of the Secretary shall be as follows:-
(a) To perform the functions related to the administration and management of the Commission,
(b) To prepare the annual budget, program and plan of the Commission and submit it to the Commission (c) To maintain and take care of the movable and immovable property of the Commission (d) To make necessary arrangements for the smooth operation of the Commission's work (e) to implement the policies, programs and decisions of the Commission, to carry out, and
(f) To perform other tasks as specified.
(6) If the post of Secretary becomes vacant, the Commission may appoint the most senior officer from among the authorized employees working in the Commission to act as Permanent Secretary until further arrangements are made.
