Section 28
Unsolicited Proposal

(1) Notwithstanding anything else written in this Act, the proposer himself may submit a proposal to the relevant body for implementing the project through public-private partnership on the basis, procedure and format as prescribed. Explanation: For the purposes of this section, "unchallenged proposal" means a proposal submitted by the investor himself with the intention of developing a project in the absence of public notice being issued by the concerned body.
(2) When submitting the proposal as per sub-section (1), the following matters should be mentioned:-
(a) Description of the project,
(B) details (profile) of the proponent including technical and financial capabilities (c) If there is a preliminary feasibility study report of the project, such report,
(d) Proposed business plan,
(e) Technology used in the project,
(f) Details of the potential benefits to be derived from the project.
(3) Based on the recommendation of the evaluation committee as per sub-section (1) of sub-section (1) of the proposal received in accordance with sub-section (1), the study and survey permit of the project or the prescribed procedure for project development or operation may be granted in the prescribed format.
(4) When evaluating the project proposal received in accordance with sub-section (1), if it is found that the project to be built in public-private partnership would be beneficial if it is carried forward on the basis of competition, the same proposal may be made competitive according to the procedure prescribed by the relevant body on the basis of the Swiss Challenge. Clarification: For the purposes of this clause, "Swiss Challenge" means that in case the concerned body receives an uninvited proposal for a service sector or a public project such as road, rail, etc., the proposal received may be better than the proposal, and the proposal can be selected by any method or process, including to a third party. It means the method to be evaluated by inviting or publicly.
(5) When negotiating on the proposal under sub-section (1), proIf the proposal of any proposer other than Tawak is accepted, from the accepted proposer, the initial expenses incurred during the development of the project and any expenses of the related body during the study and development may be provided to the proposer according to sub-section (1) as prescribed.
