Rule 17
Refusal to renew license
(1) The Controller may refuse to renew the license of the certifying body in the following cases:-
(a) If the certifying body does not submit any documents or particulars required to be submitted with the application for renewal,
(b) fails to produce any document or particulars in the possession or in the possession of the certifying body requested by the Controller,
(c) if the Controller receives credible grounds that a firm or company licensed to act as a certifying body is in the process of being wound up,
(d) In the event that the certifying body has entered into the Damasahi of the creditor and the related case is pending in any court of Nepal,
(e) if the bank guarantee furnished by the certifying authority is withheld or forfeited by the Controller,
(f) If a firm or company licensed as a certifying body and its owner or proprietor or partner commits fraud, forgery or any offense under the Act in connection with their business,
(g) If the certifying body fails to comply with the guidance or certification procedure submitted by you regarding the security of electronic records or violates such guidance or certification procedure,
(h) If performance test report is not submitted,
(i) If it is not deemed appropriate to allow the certifying body to carry out the certification from the performance test report.
(2) Before taking any decision regarding non-renewal of the license in accordance with sub-rule (1), the relevant certifying body shall be given a reasonable opportunity to disclose the reasons for refusing to renew the license.
(3) If the cleaning is not submitted according to sub-rule (2) or if the cleaning submitted is not satisfactory, the controller shall decide not to renew the license and inform the relevant certifying body.
(4) In case of a decision not to renew the license according to sub-rule (3), the notice shall be published in a daily newspaper of national level.
