Rule 19
Procedure to be followed in suspension of license
(1) According to section 20 of the Act, if the controller has to suspend the license of any certifying body, the following procedure should be completed:-
(a) To request a written explanation from the certifying body regarding the difference in the documents, details, financial and physical resources submitted during the granting of the license,
(b) To request confirmation of cash and other financial resources in the name of the certifying body for the purpose of investigating the differences in the capital structure submitted at the time of obtaining the license from the certifying body,
(c) To freeze the bank account in the name of such certifying agency or his relative until the confirmation of financial resources is obtained as per Clause (b).
(2) If a written explanation is requested in accordance with clause (a) of sub-rule (1), the certifying body shall submit the written explanation to the controller within three days from the date of such request.
(3) If there is a reasonable reason to suspend the license of the certifying body from the action under sub-rule (1), the controller may suspend the license of such certifying body.
(4) If the license of any certifying body is to be suspended in accordance with sub-rule (3), the period of such suspension shall not exceed thirty days.
(5) Within the period as per sub-rule (4), the final decision on the suspended license should be made.
(6) In accordance with sub-rule (3), the notice that the license of the certifying body has been suspended shall be published in a daily newspaper of the national level.
(7) According to sub-rule (6), the expenses incurred while publishing the information shall be borne by the relevant certifying body.
