(1) No person shall operate a private, non-governmental, cooperative or non-profit community health institution or provide health services from such institution without obtaining a license.
(2) For the health institutions as per Schedule-9, from the bodies as per the same schedule. A license will be required.
(3) Private, non-governmental, cooperative or non-profit community health organizations operating without a license at the time of commencement of this regulation shall apply for a license within three months from the date of commencement of this regulation.
(4) A health institution wishing to obtain a license as per sub-rule (2) or (3) shall submit a notification to the body as per sub-rule (2) in the format as per Schedule-10.
(5) If an application is received in accordance with sub-rule (4), the licensing authority may issue a license in the format specified in Schedule-11 after examining whether the applicant health institution meets the criteria mentioned in Schedule-8 or if it is found to have met the criteria. 6) When granting a license according to sub-rule (5), the relevant body may set necessary conditions regarding the operation of health institutions and services, and it shall be the duty of the concerned health institutions to comply with such conditions.
(7) Notwithstanding anything written in sub-rule (1), if a health institution which is operating with permission from any agency at the time of commencement of this regulation requests time to meet the standards as per rule 9 or the standards of operation as per rule 11, the licensing body shall consider reasonableness of such health institution at most The period of six months can be extended. The permission of the health institution that does not get the license within that period will be automatically revoked. After this cancellation, the property and liability of such health institution will be according to the prevailing law.
(85) If a licensed health institution wants to obtain a health institution license according to the above criteria after meeting the criteria of a higher level health institution, it must obtain a health institution license of the same level.
