Rule 23
Gratuity
: (1) If any permanent worker or employee who has served four years or more in a tea garden retires by accepting retirement or resignation from the age limit or if he is separated from the service of the tea garden in any other way, such worker or employee will receive a lump sum at the following rates Will be awarded :
(a) 1/3 month's salary for each year of the first ten years of service.
(b) 1/2 month salary for each year of service exceeding ten years up to fifteen years.
(c) For every year of service exceeding fifteen years, 2/3 month's salary accrued in that year.
(2) The amount of gratuity to be received according to clauses (a), (b) and (c) of sub-rule (1) shall not exceed seven thousand rupees, fifteen thousand rupees and twenty thousand rupees respectively.
(3) For the period before the commencement of this regulation, the amount of gratuity received by tea plantation workers or employees who are required to pay gratuity according to the rules related to factories and workers working in factories 2019 will be as per the same rules.
(4) Notwithstanding anything written in sub-rule (1), if any worker or employee is removed from service in accordance with sub-section (4) or section 54 of section 52 of the Act, such worker or employee shall not be entitled to gratuity in accordance with this rule.
