No person shall be employed under contract under any other circumstances except under the following circumstances:-

(a) If there is no suitable person within the relevant civil service of the Government of Nepal to perform any specific work of the Government of Nepal, or

(b) if any expert employee of the Government of Nepal retires and there is no other qualified government employee to take over his work and he is specially suitable.
