(1) Employees who have been adjusted according to section 6 must appear in the service positions of the union, state or local level within thirty-five days excluding the period of travel.
(2) Notwithstanding anything written in sub-section (1), the employee who is in the following condition at the time of adjustment shall report to the service post adjusted according to the same sub-section within thirty-five days after the end of the following period:
(a) An employee who is on maternity leave or maternity leave after the expiry of such leave,
(b) an employee on Kirya leave on expiry of such leave,
(c) upon the termination of such suspension by an employee under suspension,
(d) an employee on extraordinary or study leave after the expiry of such leave,
(e) From the date of discharge from the hospital by the employee admitted to the hospital due to illness.
(3) Regardless of what is written in the prevailing law, the Government of Nepal will retire the employee who does not appear within the period as per sub-section (1) or (2).
(4) According to sub-section (3), before retiring the employee from service, he shall be given a reasonable opportunity to submit clarification and explanation according to the prevailing law. Will consult.
(6) Employees who have retired as per sub-section (3) will get the facilities according to the prevailing law.
(7) The administrative head or officer of the relevant agency shall report and give responsibility to the employees who are adjusted at the union, state or local level in accordance with this Act within the specified period.
(8) The officer who does not appear and does not give responsibility according to sub-section (7) will be prosecuted according to the prevailing law.
