(1) The Government of Nepal may ensure the continuity of the services provided by the workers in the establishment to be privatized and the benefits etc. provided by them in the establishment of the new investor.
(2) In the event that it is not possible to maintain the continuity of service in accordance with sub-section (1), if it is necessary to retire the employees, workers, etc. working in such an establishment, the Government of Nepal may, on the recommendation of the committee, retire the employees and workers subject to sub-section (3).
(3) When retiring according to sub-section (2), the Government of Nepal shall make appropriate arrangements for compensation or facilities after taking the recommendation of the committee in relation to the employees or workers retiring from the establishments to be privatized.
(4) Government of Nepal will provide some shares of that establishment to the employees and workers working in the establishment to be privatized.
