Section 41
Crime and Punishment

(1) If anyone commits the following act, he shall be deemed to have committed an offense under this Act:-
(a) In case of stealing or stealing of examination papers, impersonation of another, or in case of doing irregular work in the examination by using electronic equipment,
(b) If the examinee takes his answer book with him without returning it, if he does not return the question paper specified by the Commission to be returned, if he makes a copy of such question or makes it public through an electronic device, (c) without the approval of the relevant official at the examination center where the Commission is conducting the examination, during the examination time specified by the Commission If he enters or attempts to enter or disturbs the conduct of the examination by rioting in the examination center,
(d) Examination in the name of another, if given or administered,
(e) If the examination center that conducts the examination is taken under control or if an attempt is made to take control of the examination center, or if there is hujhujjat or any other act in the examination center, obstructing the examination. If obstruction is reached or attempted to be reached,
(f) In case of breaching the confidentiality of the examination in any way.
(2) If anyone commits the following acts, the Commission may bar him from being a candidate in the examination conducted by the Commission for the following period:-
(a) For two years in case of contravention of clause (a) of sub-section (1),
(b) for three years in case of contravention of clause (b) of sub-section (1),
(c) For up to four years in case of contravention of clause (c) of sub-section (1),
(d) Up to five years in case of violation of clauses (d), (e) or (f) of sub-section (1).
(3) Whoever cheats in an examination contrary to clause (a) of sub-section (1) or commits an act contrary to clause (c) shall be liable to a fine which may extend to one lakh rupees or to imprisonment for a term which may extend to six months or to both.
(4) If anyone commits an act contrary to clause (d), (e) or (f) of sub-section (1), he shall be fined from fifty thousand rupees to one lakh rupees and imprisoned for a term from three months to six months. (5) If a person who has been suspended from an examination in accordance with clauses (a), (c) or (d) of sub-section (2) is acquitted by the court in the case of an offense under sub-section (3) or (4), such suspension shall be automatically lifted.
