Section 22
Property related to crime to be returned

(1) When extraditing a fugitive accused or a criminal, the property related to the crime and other property acquired from the crime at the time of arresting such accused or criminal in Nepal may be returned to the requesting state by the Government of Nepal.

However, the property that appears to have the rights, claims or any other kind of liability of someone else will not be returned.

(2) In the case of immovable property related to the crime of a fugitive accused or a criminal who has been handed over to the requesting state by the Government of Nepal. If it is determined to be confiscated by a competent court, action will be taken to return such property.

(3) If the property to be returned according to this section is in any form other than cash, it shall be sold at the prevailing market price and returned in cash.

However, the property which is presented as evidence of the offender or demanded by the state to be returned to the state shall be returned to the state.
