(1) An organized organization established in accordance with the law shall acquire legal personality and shall acquire legal competence in the same capacity.
(2) According to sub-section (1) in order to obtain legal competence, an organization must be registered according to the law.
(3) In order to be registered in accordance with sub-section (2), unless there is a separate provision in the law, an application should be made to the concerned authority to disclose the following matters:-
(a) Name of the Incorporating Body,
(b) the head office of the incorporated organization and the address where such office is located (c) the objectives and functions of the incorporated body,
(d) Details of the capital structure of the incorporated organization, if any (e) Other necessary details.
(4) After registration of the organization in accordance with sub-section (2), such organization shall be deemed to have been established.
(5) The legal person shall have a corporate personality and shall use a separate seal for its operations.
(6) The organization established under this section shall be a self-governing and organized organization with inalienable succession and shall be subject to law and in the same capacity as a person may do the following:-
(a) to acquire, hold, acquire, enjoy, sell or otherwise manage property,
(b) To enter into a contract, to exercise rights and perform obligations under the contract or to accept any rights or obligations in any other manner,
(c) to make laws or regulations necessary to carry out its work, action or business,
(d) to appoint employees subject to law to perform their duties,
(e) To open a branch or other office subject to its statutes and regulations,
(f) To open and operate an account in any bank or financial institution,
(G) To do other work according to the law.
(7) A legal person may file a lawsuit or other legal action in his own name or may file a lawsuit or other legal action against such a person in the same name.
