(1) If any work to be carried out by the Government of Nepal must be completed within a certain period (performance contract) or if it is to be carried out in such a way that a certain quantity is available, or if there is a priority program or project to be implemented from the national point of view of the Government of Nepal, such work shall be carried out by entering into a performance contract with an official. The responsibility can be given to him.
(2) In addition to other things, in the contract according to sub-section (1), the officer who has been given the responsibility must also mention the details of the work to be done, the time period in which the work must be completed and the quality or quantity of the work.
(3) If there is an agreement as per sub-section (1), the person who has been given responsibility according to that agreement shall perform the work in accordance with such agreement. (4) If any circumstances beyond the control arise and the work to be performed according to sub-section (3) cannot be completed within the period for which the work is to be performed, Details with reasons should be submitted to the secretary of the concerned ministry.
(5) If the details submitted in accordance with sub-section (4) are found to be reasonable, the work performance contract may be amended to shorten the period for which the work could not be carried out due to an uncontrollable situation.
(6) Departmental action shall be taken against officials who are unable to perform their duties within the period specified in sub-section (3) or (5) without reasonable cause.
(7) If the person who has the responsibility according to this section does not perform the work with bad faith, misbehavior or fraud, if there is loss or damage to the Government of Nepal or if the cost of the project is increased, the compensation for the cost of such loss or increase can be paid by him as prescribed.
(8) Other provisions related to the performance contract shall be as prescribed.
