Rule 40
Executive Director's remuneration, facilities and other conditions of service

(1) The monthly salary and other benefits of the Executive Director will be as determined by the Government of Nepal.
(2) The Ministry shall enter into a performance contract with the executive director, mentioning the remuneration, facilities and other conditions of service.
(3) Other provisions related to the terms of service of the executive director shall be as mentioned in the regulations. the scholar Duties, duties and rights of the executive director: In addition to the duties, duties and rights mentioned in the Act, the other duties, duties and rights of the executive director shall be as follows:-
(a) Prepare the annual plan and program of the authority and submit it to the committee for approval (b) Supervising and controlling the funds of the Authority,

(d) To protect the property of the Authority and to keep up-to-date details of the property or assets, (e) Acting as a liaison officer between the Government of Nepal, authorities and other agencies (f) To do all the work to be done on behalf of the authority except as otherwise written in the Act or this regulation,
(g) To exercise other duties, duties and rights as assigned by the committee. dddd Provisions related to staff: (1) The number of positions and organizational structure of the staff in the authority will be as approved by the authority with the consent of the Ministry of Finance.
(2) At the request of the Authority, the Ministry shall, upon the request of the Authority, appoint or assign employees of any organization owned by the Government of Nepal or any organization owned by the Government of Nepal to work in the Authority by receiving remuneration, allowances and facilities from the Authority until such time as the staff are appointed in accordance with the approved posts of the Authority. (3) Other provisions related to the appointment, remuneration, allowances, facilities and conditions of service of the employees of the authority shall be as specified in the staff regulations. dd. To be converted into an employee of the authority: (1) Commencement of the ActThe employees who are working on the permanent appointment of the Special Economic Zone Development Committee, which is in place during the period, will automatically be converted into the employees of the Authority after the commencement of this regulation.
(2) Permanent employees of Nepal Civil Service or Nepal Government-owned organizations who are working in the Special Economic Zone Development Committee at the time of commencement of the Act shall submit an application to the Authority within one month from the date of commencement of this Regulation.
(3) If an application is received in accordance with sub-rule (2), the authority shall submit a recommendation to the ministry with the opinion that it is appropriate or not to convert such employee into the service of the authority based on the need, suitability and experience of such employee's service. In the case of employees of institutions owned by the Government of Nepal who have been recommended in that way, the Ministry will send them to the relevant institutions for necessary decisions.
(4) According to sub-rule (3), if it is appropriate to convert any employees of the Nepal Civil Service into the service of the Authority, the Ministry will submit a proposal to the Government of Nepal for approval.
(5) If the proposal received in accordance with sub-rule (4) is found to be reasonable, the Government of Nepal will consult with the Public Service Commission and convert such employees into the service of the Authority by mentioning the benefits to be enjoyed by the employees who will be transferred.
(6) In the case of employees of organizations owned by the Government of Nepal, if consent is obtained from the relevant organization, the authority will convert such employees into the service of the authority. (7) Employees who have not been transferred to the service of the Authority in accordance with this rule shall be returned to the office where they are posted by the Authority within seven days. But there will be no hindrance to such employees to continue working in the authority after taking the approval of the relevant body until the staff positions in the authority are filled.
(8) The Authority shall bear all the responsibilities of the employees who have been transferred to the service of the Authority in accordance with this rule.
