Section 114
Making an application to the office
: (1) In the following cases, the concerned party may make an application to the office to resolve the personal claim under section 113 through conciliation:
(a) If the employer does not give notice for discussion within seven days of receiving the application as per sub-section (1) of section 113 or,
(b) 15 days after the initial application before the employer, if no agreement can be reached during the discussion according to sub-section (3) of section 113.
(2) If an application is received according to sub-section (1), the office shall give notice to the concerned employer and employee regarding the date and time for the discussion.
(3) The office shall resolve the dispute related to the claim by conducting necessary negotiations between the employer and the worker within twenty-one days of receiving the application according to sub-section (1).
(4) Regardless of what is written in sub-section (3), the period for resolving the dispute can be extended based on the agreement between the office, the employer and the employee.
(5) If there is an agreement between the concerned employer and the worker during the negotiations as per sub-section (3), the dispute related to employment shall be deemed to be resolved.
(6) The agreement reached in accordance with sub-section (5) shall be binding on the parties concerned.
