Rule 12
Diplomatic passport

(1) The department shall issue a diplomatic passport to the following officers who are going on a foreign visit in connection with government work, if written by the relevant constitutional body or ministry or secretariat or court or office:-

(a) President,

(b) Vice-President,

(d) Chief Justice,

(e) Constituent Assembly Speaker - Legislature - Speaker of Parliament,

(f) Deputy Prime Minister,

(g) ) Minister,

(h) Leader of Opposition in the Legislative Parliament,

(j) Constituent Assembly Vice President/Deputy Speaker of Legislature-Parliament,

(j) Minister of State, Vice President of National Planning Commission, Chancellor of Nepal Pragya Pratishtans,

(k) Judge of Supreme Court, Member of Judicial Council,

(l) Assistant Minister, Member of Constituent Assembly/Legislature-Parliament,

(d) Heads of Constitutional Bodies, Attorney General, Chief Secretary to the Government of Nepal, Commander-in-Chief, General Secretary of the Constituent Assembly/Legislature-Parliament,

(d) Chief Justice of the Court of Appeal, Member of the National Planning Commission, Officials of Constitutional Bodies, Governor of Nepal Rastra Bank, Chairman of the University Grants Commission, Vice-Chancellors of Universities and Institutes,

(n) Secretary of the Government of Nepal or special category employees of the Government of Nepal, Judges of the Court of Appeal,

(p) Nepali Army, Nepal Police, armed Officers of the police and Nepal Special Service of special rank,

(th) Nepali Ambassador, Permanent Representative of Nepal to the United Nations, Head of Mission and their familiesAnd,

(The) Assembly of District Development Committee (elected), Head of Municipal Corporation (elected),

(d) Gazetted authorized employees working in the Ministry of Foreign Affairs and departments or offices under it,

(n) Official, formal and informal of the President according to the decision of the Government of Nepal Council of Ministers Members of the visiting party involved in foreign visits and formal and informal visits of the Vice President and Prime Minister,

(p) According to the decision of the Cabinet of Ministers of the Government of Nepal, the United Nations General Assembly, Special Assembly and A member of the visiting team representing the Government of Nepal to participate in international and regional summits including the general assembly of other specialized bodies of the association, the general assembly of the Asian Development Bank, the South Asian Regional Cooperation Organization (SAARC), the summit of BIMSTEC,

(f) employees of the Government of Nepal on deputation and their family members,

Explanation: For the purpose of this section, "family member" That means "husband, wife, son, daughter, adopted son, adopted daughter, father, mother or step-mother or married female employee who lives with him and has to be taken care of by himself should be considered as his mother-in-law, father-in-law."

(b) a person appointed on a special mission representing the Government of Nepal, and

(c) any specific decision by the Minister of Foreign Affairs of the Government of Nepal Persons designated to issue diplomatic passports for the purpose.

(2) Notwithstanding anything written in sub-rule (1), the following persons who wish to go on a foreign visit should obtain a diplomatic passport along with the recommendation of the relevant constitutional body or ministry or secretariat or court or office. The Department shall, upon request, issue a diplomatic passport with a validity of five years to:–

(a) a former President,

(c) Former Prime Minister,

(d) Former Chief Justice,< /p>

(e) Former Speaker of the Constituent Assembly / Speaker of the Legislature-Parliament,

(f) Former Foreign Minister Minister.

(3) If a former official who has a diplomatic passport as per sub-rule (2) wants to take his spouse with him on a visit, his spouse, if recommended by the relevant constitutional body or ministry or secretariat or court or office, also The department may issue a diplomatic passport with a maximum period of one year.

(4) If the spouse or wife of the official who has a diplomatic passport has to accompany him or he wants to accompany him or her while traveling abroad in connection with official work, the visiting official is a constitutional If recommended by an agency or ministry or secretariat or court or office, he can also be issued a diplomatic passport with a maximum period of one year. The Department may issue diplomatic passports for a maximum of five years to Nepali citizens working in the position of Assistant Secretary General or equivalent or above in other intergovernmental organizations of which Nepal is a member, and their spouses, taking into account the tenure of their positions.

(6) The Department may issue diplomatic passports to the Secretary General of the South Asian Association for Cooperation (SAARC), the Secretary General of WIMSTEC and their family members appointed on behalf of Nepal for the duration of their term of office. The validity period of the passport will be as determined by the department taking into account the current tenure or service of the passport bearer. When diplomatic passports are issued, diplomatic passports shall normally be issued for a period of one year and members of the visiting party participating in such visits shall be subject to this rule.A person other than an official who receives a diplomatic passport in accordance with this shall return the diplomatic passport issued in his name to the department within fifteen days from the date of completion of such visit. If it is not returned within that time, the department will cancel the said passport.

(9) Regardless of what is written elsewhere in this regulation, the department will hold a period of one to five years to a person who has been decided to issue a diplomatic passport by the decision of the Government of Nepal, the Council of Ministers or the Minister of Foreign Affairs.

(10) According to this regulation, a person who is working abroad with a diplomatic passport, if his term of office expires while he is working, to issue a diplomatic passport after a maximum of six months from the date of his retirement. will end Such a facility will also be available to his family members living abroad after receiving a diplomatic passport.

(11) No fee shall be charged for issuing a diplomatic passport.
