Section 40
Calculation of imprisonment period
(1) When calculating the period of imprisonment, it shall be calculated from the date of detention or imprisonment if the offender is in custody or from the date of imprisonment if he is not in custody.
(2) The days of release from custody or imprisonment during the period as per sub-section (1) shall not be counted in the period of imprisonment.
