(1) While determining the amount of compensation to be given for real estate to be acquired under this paragraph, the committee shall consider and determine the following matters:-
(a) The value of the said real estate at the prevailing market rate on the date of issue of notice under sub-section (1) of section 4,
(b) the loss to be borne by the concerned person if the standing crops and trees on that land are taken,
(c) If the concerned person has to leave his place of residence or place of concern, the expenses of the manasib mafiq should be borne by him.
(2) After determining the amount of compensation according to sub-section (1), the Divisional Forest Officer shall give notice to the interested party to come and collect such amount.
(3) A person who is not satisfied with the amount of compensation may appeal to the Ministry within thirty-five days from the date of receiving the notice as per sub-section (2). The decision of the Ministry in such an appeal will be final.
(4) If the said compensation amount is not collected within five years from the date of receiving the notice as per sub-section (2) or the decision as per sub-section (3), the said amount shall be deposited in the reserve fund.
