Rule 15
Compensation
:
(1) If the Government of Nepal decides to give compensation in relation to the right of ownership of land acquired in accordance with Rule 14, the amount of compensation to be given to each person or his family at the rate of 25 percent of the value of the land at the rate determined according to Rule 21 shall be determined by the District Land Reforms Officer and notified thereof. The local village development committee or municipality and the notice board of their office should publish the TAC.
(2) According to sub-rule (1) within 15 days of the publication of the notice of compensation determination, if it appears that the determination of compensation must be repeated from the complaint of those who claim the amount of compensation or who are not satisfied with the determination of compensation or from any other source, the district land reform officer shall publish the repetition as written above.
(3) A person who is not satisfied with the notice of compensation determination published in accordance with sub-rule (1) or with the notice published repeatedly in accordance with sub-rule (2) shall appeal to the court specified in the notified order within 10 days from the date of first publication or repeated publication of the said notice, as the case may be. (4) If the deadline for filing an appeal has passed in the notice of compensation determination published as written above and no appeal has been filed, the district land reform officer will give the amount of compensation to the concerned person in accordance with sub-rule (5) in accordance with the published notice and in the case of a complaint, according to the final decision of the complaint. If the amount of compensation is more than the amount of such creditor, the claimant will get the higher amount and if it is less, the amount will be reduced.The creditor will be able to claim on Asami in as many bags as possible.
(c) The creditor who is enjoying the right of mortgage of any land cannot enjoy that right according to section 8 of the Act. According to (b), if the claimant gets a refund, the bond of such creditor will be forfeited from the date of receiving the refund. (5) Mohiani Haq After the land is transferred to another person, the amount of compensation will be given in cash to the concerned person in 5 annual installments. Interest will be given at the rate of 5 percent per annum on the compensation amount.
