Rule 5
Eligibility of person wishing to obtain mineral working permit

(1) The qualification of a person who wants to obtain a permit for the mining of mineral substances falling within the category of extremely important minerals shall be as follows:-
(a) Having two years of experience in the work related to mineral work or having the ability to employ an expert in the related mineral work.
(b) Having financial status of four lakh rupees per square kilometer for the total mineral area to be worked on for exploration work and three lakh rupees per square kilometer for the total mineral area to be worked on for mining.
(2) The qualification of a person who wants to obtain a permit for the mining of minerals belonging to important and valuable minerals shall be as follows:-
(a) Having two years of experience in the work related to mineral work or having the ability to employ an expert in the related mineral work.
(b) Having a financial status of Rs.200,000 per square kilometer for the total mineral area to be worked on for exploration work and Rs.20 lakh per square kilometer for the total mineral area to be worked on for mining.
(3) The qualification of a person who wants to obtain a permit for the mining of mineral substances falling under general minerals shall be as follows:-
(a) Having one year of experience in related mineral work or having the ability to hire an expert in related mineral work.
(b) having financial status of one lakh rupees per square kilometer for the total mineral area intended to be mineralized for prospecting and ten lakh rupees per square kilometer for the total mineral area intended to be mineralized for mining.
(4) For the purpose of this rule, the applicant for a permit to employ an expert related to mineral work shall submit a commitment letter approved by such expert to provide necessary technical services for mineral work, a copy of the expert's registration certificate obtained by the expert and the tax receipt of such expert.A copy of the certificate must be submitted.
(5) For the purposes of this regulation, the petitioner shall submit a document appraised by the village development committee or municipality regarding land, house or any other movable or immovable property, or a copy or statement of the deposit in his name in the bank or a statement confirming the petitioner's financial status. Proof of the value or amount of movable and immovable property in the name must be submitted.
