Section 7
Responsibility for Procurement

(1) The head of the relevant public body shall be responsible for carrying out procurement-related work in accordance with the procedure according to this Act.
(2) When the public body carries out the work related to procurement according to sub-section (1), it shall be conducted by employees who have the qualifications determined by the Public Procurement Monitoring Office and who have the knowledge or training related to procurement work.
(3) The public body shall establish a separate division, branch or unit and appoint a procurement officer based on the procurement-related workload and nature of work to perform the following tasks:-
(a) Preparation of procurement plan,
(b) Pre-qualification according to the requirements of the standard bidding document (standard bidding document), standard pre-qualification document (standard pre-qualification document), standard contract document (standard contract document) prepared by the public procurement monitoring office. Preparing related documents, tender related documents and purchase contract related documents,
(c) To prepare a document related to the proposal of consulting services as required without substantially differing from the standard request for proposal document prepared by the Public Procurement Monitoring Office,
(d) Publicly publishing information related to procurement,
(e) Distributing documents related to pre-qualification, documents related to bidding or sending documents related to proposals for consulting services,
(f) Receive and secure pre-qualification proposals, bids or proposals for consulting services,
(g) To submit to the Evaluation Committee for evaluation the pre-qualification proposals, tenders or proposals for consulting services and to submit the evaluated bids for approval,
(h) Notification of acceptance of proposal for pre-qualification, tender or proposal for consultancy services,
(i) To take performance security and test it and keep it in a safe manner,
(j) purchasedConduct quality testing of goods, construction work or services,
(k) Providing information and documents requested by the Public Procurement Monitoring Office, and
(l) To perform other specified tasks.
(4) While doing or carrying out work as per sub-section (3), the officer assigned responsibility for the procurement department, branch or unit shall take the approval of the head of the relevant public body.
(5) The work, duties and powers of the head of the procurement department, branch or unit established in accordance with sub-section (3) shall be as prescribed.
(6) It shall be the duty of the head of the concerned public body to ensure that the work is completed within the stipulated time by conducting regular supervision, monitoring and quality control in order to implement the purchase agreement made in accordance with this Act.
