Section 8
Purchase method to be chosen
(1) When purchasing, the public body shall purchase by adopting one of the following methods based on the conditions and purchase price as specified.
(a) In case of procurement of goods, works or other services: –
(1) By inviting open tenders at the international level,
(2) By inviting open tenders at the national level,
(3) Calling for a sealed bond,
(4) By purchase,
(5) By involving consumer committees or beneficiary communities,
(6) From deposit.
(7) Lump sum and method, Explanation: For the purpose of this sub-section, "lump rate method" means the method of submission of tenders by stating the percentage of work to be done for each unit, less or more than the total number of quantity and cost estimate.
(8) By the method of purchasing by the manufacturer or authorized seller at the fixed rate (catalog shopping), Explanation: For the purpose of this sub-section, "by the method of purchasing by the manufacturer or authorized seller at the fixed rate (catalog shopping)" means a company manufacturing any goods on the basis of product characteristics, quality features After publishing the sales price determined on the relevant basis on the website or document (brochure) of the relevant company, it should be considered the purchase method by competing with the price set by the company producing the same level of goods.
(9) Limited Tendering, Explanation: For the purposes of this sub-section, "Limited Tendering" means the procurement of goods, works or services by a limited manufacturer, supplier or service provider. It should be considered a procurement method that is conducted only between producers, suppliers or service providers.
(10) Buy-back method Explanation: For the purposes of this sub-section, “buy-back method” means auctioning or stockpiling which after a certain period becomes unreasonable or from public health or environmental considerations.Goods or machinery tools that cannot be kept or used should be evaluated as specified and returned to the relevant manufacturer or supplier and taken as a new method.
(b) When purchasing consultancy services: –
(1) By soliciting competitive proposals,
(2) From the same conversation.
(2) When purchasing in accordance with this Act and the rules made under this Act, the purchase should not be made piecemeal so as to limit competition.
(3) The provisions related to procurement method as per sub-section (7), (8), (9) and (10) of clause (a) of sub-section (1) shall be as prescribed.
