Section 38
Entering into the purchase agreement
(1) The offeror's proposal that has been agreed upon in the negotiations according to section 37 will be selected for acceptance.
(2) According to sub-section (1), within seven days after the selection of the proposal, the public body shall give notice of the intention to accept the proposal so selected to the respective proposer and to the other proposers in the list.
(3) If a proposer does not make an application in accordance with section 47 within seven days of the notification under sub-section (2), the proposal of the selected proposer under sub-section (1) shall be accepted and he shall be given a period of fifteen days to come to an agreement.
(4) If he is present to make the agreement within the period as per sub-section (3), he shall make the agreement as per section 52 and if he is not present, the public body shall, in the case of the proposer of clauses (a), (b) and (c) of sub-section (1) of section 35, In the case of Clause (d), the one with the highest score and the lowest cost shall be negotiated with the other bidder in accordance with Section 37 and an agreement shall be made as per Section 52.
