Extendable period of purchase agreement

(1) In the event that the work according to the purchase agreement cannot be completed within the period of such agreement due to the situation according to Section 56 of the Procurement Act, the relevant builder, supplier, service provider or consultant shall disclose the reason and submit an application for extension of the period to the relevant local body at least seven days before the expiry of the purchase agreement. will fall.
(2) After receiving the application according to sub-rule (1), the head of the concerned local body may conduct or cause the necessary inquiry in that regard. While making such an inquiry, he should consider the following:-
(a) whether the concerned builders, suppliers, service providers or consultants have made their best efforts to complete the work as per the purchase agreement on time,
(b) Whether or not the relevant local body has provided the builders, suppliers, service providers or consultants with what is required to be provided according to the contract,
(c) Whether or not the work has been delayed due to circumstances beyond control.
(3) During the investigation according to sub-rule (2), if the reason mentioned in the application is found to be reasonable, the period of up to three months can be extended by the authority approving the bid and the relevant local body can extend the period beyond that.
