Section 8
Punishment
for those who act with malice for unlawful gain or loss (1) If any national servant commits any of the following acts with the intent to bring illegal benefits to himself or to any other person or to cause illegal harm to the Government of Nepal or a public institution, he shall be imprisoned for three months to three years depending on the amount of the offense and shall be fined in accordance with the above. will be done. (a) showing unreasonable excess of work or cost without any basis of justification when studying the feasibility of the project or preparing the numbers,

(c) reducing the quality of construction work without reasonable cause, changing its shape or form, or carrying out construction work contrary to the prescribed conditions and standards, or certifying or approving such construction work as being of good quality, in accordance with the conditions and standards,
(d) Unreasonably increasing and revising cost estimates without reasonable cause, causing,
(e) Falsifying bills, receiving, giving or receiving double payment of bills,
(f) purchasing, causing,
unnaturally more goods than required without reasonable cause (g) To make, cause, abnormal assessment of government or public institutions or public property (h) Illegally registering, using, using government or public property in one's name or in the name of others (i) In case of mortgage of any property in the name of the government or public institution, the valuation of such property is unnaturally higher than its actual value, causing,
(j) Buying goods that are of poor quality, out of date and unnaturally high prices.
(2) Any means or facilities received by a national servant from official status shall be revoked without reasonable cause after the termination of such statusIf it is not returned within the specified time, such instrument or facility will be withdrawn and fined from one thousand rupees to five thousand rupees depending on the amount of the offense.
(3) If a national servant maliciously damages or causes damage to government or public property by doing any other work other than what is written in sub-sections (1) and (2), he will be punished with imprisonment for up to two years or fine or both according to the amount of the offence.
(4) If a person other than a national servant does not comply with the oath, confession, agreement, contract, license, permit, pledge or dealership condition made before the Government of Nepal or a public institution with the intention of giving himself or any other person an illegal benefit or as prescribed by the Government of Nepal or such institution. If he does business in a manner prohibited by the prevailing law in violation of the rules or procedures or accepted conditions, or if he misuses the facilities or rights of the government or such organization, he will be imprisoned for two years according to the amount of the offense or fined and confiscated as appropriate.
