: (1) According to sub-section (1) of Section 4 of the Act, if skilled Nepalese nationals are not available to work in tea plantations, the manager of such tea estate shall take the approval of the Labor Department on the recommendation of the relevant labor office for a maximum period of two years at a time. Any skilled non-Nepali citizen can be appointed and employed on contract basis.
(2) Sub-rule (1) The manager who frequently employs non-Nepali citizens shall arrange for the replacement of Nepali workers or employees by making them skilled in the work performed by such non-Nepali citizens.
