(1) The governor, deputy governor or director or employee, adviser, auditor, agent or representative of the bank shall not do the following:- (a) give to others any published or unpublished confidential information or information received while working in his official capacity. (b) to use such information or information for private gain. (2) Notwithstanding anything contained in sub-section (1), the bank may disclose published or unpublished information of its knowledge in accordance with the prescribed procedure in the following cases:- (a) When publicly performing his duties, assisting law enforcement agencies, bringing such information to light by a court order or due to the order of a competent authority, (b) for giving such information to the bank's external auditors and employees of international financial institutions in the course of fulfilling his duties, and (c) ) If such information is published for the benefit of the bank in connection with legal proceedings.
