Section 9
Doctor's opinion
:
(1) If an abortion of a pregnant woman is performed with the permission of the concerned woman on the grounds that the following consequences may occur, the physician shall write an opinion in the format as per Schedule-7.
(a) endangering the life of the pregnant woman concerned,
(b) Physical or mental deterioration of the health of the pregnant woman concerned,
(c) Giving birth to a disabled child. Explanation: For the purpose of this section, "handicapped" shall mean any of the following conditions:-
(a) There is a possibility of death in the womb due to severe deficiency, weakness in the fetus or there is a defect in the fetus such that it cannot survive even after birth,
(b) There is a serious physical or mental disability in the child due to genetic disorder or any other reason.
(2) Notwithstanding anything mentioned in sub-section (1), the opinion of a physician shall not be necessary in case of abortion of a pregnant woman for any of the following reasons:-
(a) with the consent of a pregnant woman up to twelve weeks' gestation,
(b) With the consent of a pregnant woman up to eighteen weeks' gestation who has undergone coercion or forced labor.
