Section 84
Special Provisions Regarding Tea Plantation Workers

(1) The employer's liability towards tea plantation workers shall be as follows:-
(a) Arranging suitable accommodation within the tea garden for the tea garden workers and their dependent families who do not live near the tea garden,
(b) providing free first aid for minor injuries to tea plantation workers and their dependent family members and arranging medical supplies including trained persons for the same,
(c) If there is no market facility near the tea garden, arrangements should be made so that daily necessities can be made available in a simple way,
(d) Arranging proper arrangements for sports and entertainment for the physical and mental development of tea plantation workers and their dependent family members. Explanation: For the purpose of this section:-
(1) "Tea plantation" means a tea plantation registered in accordance with the prevailing law and the word refers to the factory established within the tea plantation, other physical infrastructure and its premises.
(2) "Tea plantation worker" means a laborer who digs, ploughs, prepares, threshes, sows, sows, threshes, cuts, plucks, uproots or any other similar work on the land of a tea plantation and by that term means tea processing and any other part of the tea plantation. It also refers to the workers involved in the work.
(3) "Dependent family" means the family of the tea plantation worker who lives with him and has to be supported by him.
(2) This section shall not be deemed to be an obstacle to the conclusion of an agreement between the workers and the employer working in the tea garden regarding the completion of any work of the tea garden.
