Rule 8
Investigate
(1) According to sub-rule (2) of rule 7, after the concerned person has given his statement or after receiving the details or after the deadline as per the said sub-rule has passed, the complaint shall be submitted to the member designated by the commission or to the member designated by the chairman in case there is no such member and The head of the investigation branch should attach all the documents related to the complaint and submit them. (2) According to sub-rule (1), after the complaint and documents are submitted, regarding further investigation on the matter. The concerned member will submit the file related to the complaint to the commission to take the necessary decision.
(3) the nature and condition of the complaint from the complaints and documents submitted in accordance with sub-rule (2); According to Section 10 of the Act, if further investigation is required, the commission may conduct the investigation itself, form a committee, or appoint an authorized employee of the commission.
(4) When forming a committee according to sub-rule (3), it may be constituted as per the need of the commission - members, employees, experts of related subjects, representatives of security agencies, lawyers, government lawyers, rights workers, local representatives, interpreters or facilitators.
(5) The member, employee or investigation committee appointed by the Commission to conduct an investigation in accordance with this rule may exercise the same investigation powers as the Commission has in accordance with the prevailing law and this regulation while investigating the complaint.
(6) During the investigation according to this rule, if there is a credible basis that someone has committed violence against women or violation of women's rights, for on-site inspection, if it is necessary to enter someone's private house, residence, office, agency, etc. In order to enter such a house, the owner or the person or organization that enjoys the property can immediately make a bond and enter with the help of the police in accordance with the prevailing law.
(7) The employee or the committee as per sub-rule (3) shall submit their report with opinion to the commission within seven days after the investigation.
(8) Period as per sub-rule (7).If the report cannot be submitted, if more time is required for the investigation, if the member designated by the commission asks for more time with reasonable reasons, fifteen times at most, once or twice, depending on the progress of the work; The period can be extended up to days.
