(1) In case any land located in an area other than the area prohibited in accordance with sub-section (1) of section 12 is temporarily or permanently required for mineral work, to use subject to the following matters or Can be obtained :–
(a) If such land belongs to the Government of Nepal, the permit holder can use it by paying the land restoration as prescribed to the Government of Nepal.
(b) If such land is privately owned, the Government of Nepal may acquire it or give it to the person who has received the permission at his own expense in accordance with the prevailing law. , if it is necessary to install tools or to do any other work related to the measurement map or mineral work, he may enter such land subject to sub-section (3) and do such work. If the land owner is not able to use his land or if there is damage to the crops, trees, houses, goods or other property on such land, compensation will be given to the concerned land owner after consulting the village council or the municipality.
