Rule 16A
Can apply for lease or transfer of land:

(1) Section 12c of the Act. If the agricultural farm, industry, establishment, company or organization that is not being used by the agricultural farm, industry, establishment, company or organization as per Clause (2) of the restrictive sentence wants to operate such agricultural farm, industry, establishment, company or organization in another place by leasing or transferring it, attach the following details and documents _ to the department in the format as per Schedule-5A. Can apply:-
(a) A document confirming the reasonable and sufficient reason for the land lease or transfer,
(b) When leasing or transferring, the commitment to transfer the agricultural farm, industry, establishment, company or organization from the lease in such a way that it does not conflict with the purpose of the lease,
(c. In the plan and acknowledgment of the proposed land purchase plan so that the production of the land will not decrease after the transfer of the land use subject to the prevailing law on land use,
(d) In the confession with the assurance that the land will not be purchased with an area less than the land used by him in the past,
(e) on admission not less than the number of employments being provided at the time of commencement of this rule,
(f) An environmental study report approved in accordance with the prevailing law regarding the environmental impact of the place to be leased or relocated,
(G) Letter of recommendation from the body registering such agricultural farm, industry, establishment, company or organization (2) The department shall check whether the details and documents mentioned in sub-rule (1) are attached to the notification or not.
(3) If it is found that the details and documents mentioned in sub-rule (1) are not attached during the inspection according to sub-rule (2), the relevant agricultural farm, industry, establishment, company or organization shall be notified to submit the necessary details and documents within seven days.
(4) After checking according to sub-rule (2) or after receiving the details and documents according to sub-rule (3), the department shall conduct on-site inspection of such agricultural farm, industry, establishment, company or organization as required and determine whether the petitioner's demand is appropriate or not.Prepare a detailed report and send the report with your opinion, the petitioner along with the attached details and documents to the ministry.
(5) According to sub-rule (4): If the petitioner's demand is deemed suitable after studying the received details and documents, the ministry shall submit the related proposal to the Government of Nepal and the Council of Ministers for approval.
(6) If the proposal submitted in accordance with sub-rule (5) is deemed suitable, the Government of Nepal, the Council of Ministers may give approval for the necessary conditions to transfer the land in the name of such agricultural farm, industry, establishment, company or organization by lease.
(7) In accordance with sub-rule (6), land used by agricultural farms, industries, establishments, companies or organizations that have received permission to sell or transfer land, the owner of such land that is maintained after the sale or transfer shall be subject to section 12 of the Act and shall take approval of the limitation exemption.
