Rule 28
Water Resources Utilization Investigation Committee

(1) If any dispute arises during the use of water resources, there will be a Water Resources Use Inquiry Committee with the following chairman and members to resolve such disputes:
(a) Representative, Ministry of Water Resources – Chairman
(b) Representative, concerned District Development Committee – Member
(c) Representative, Regional Office of National Planning Commission – Member
(2) If there is a dispute regarding the use of water resources between two or more districts, according to clause (b) of sub-rule (1), there will be one representative of the District Development Committee of each district related to the dispute.
(3) The Water Resource Utilization Investigation Committee under Sub-rule (1) shall adopt the following procedures when resolving disputes arising from the use of water resources:
(a) If there is a dispute between the local people benefiting from the water resource use project regarding the determination of the priority of water resource use or the harm caused to the local people due to the implementation of any water resource related project, the facts that all the relevant license holders, organized organizations and local people separately or collectively confirm their claims. A reasonable deadline for submission of written information should be specified.
(b) After receiving the written information within the specified period according to Clause (a), the on-site study including the project site should be conducted and information should be obtained mainly on the following matters:
(a) Total cost of the project,
(b) Level of benefit from the project,
(E) The impact that may be caused to the people or groups who are using the related water resources during the operation of the project (e) Number of consumers who will benefit from the project,
(g) Impact on the environment during operation of the project,
(u) the needs of the local people,
(a) Response of consumers benefiting from the project,
(A) Other essential matters.
(c) After receiving the information on the subjects mentioned in clause (b), based on that, it will be determined whether the water resource has been used beneficially and whether the water resource can be used.
(d) According to clause (c) of sub-rule (3), while determining the matter related to the use of water resources, the water resource use investigation committee may also specify the conditions for using any water resource.
