(1) After a complaint has been filed in a case, the court shall inquire into the following matters in relation to it:-
(a) The claim of the plaintiff or the accusation he seeks to make against the defendant. Is it based on law or not?
(b) Whether the evidence presented or sought to be presented by the plaintiff is relevant to the case and whether the evidence is sufficient to prove the facts stated in the complaint?
(2 (3) Subsection (2) ) unless the complaint is dismissed, the court shall:-
(a) If the defendant appears in court, action shall be taken immediately by taking his statement. A period of seven days shall be given. If it appears from the evidence obtained immediately that a case should be prosecuted against a person, the court should set up a pamphlet mentioning the following and take action in accordance with clauses (a) and (b) of sub-section (3):-
(a) Full name of the defendant and address, (b) the cause of action, and (c) evidence thereof.
