Rule 13
No bar to file additional charge sheet

(1) Notwithstanding anything written elsewhere in this regulation, if an indictment has been filed against an accused in accordance with this regulation and the case is being tried by a military court, if additional evidence is obtained later, it is necessary to demand additional indictment against such accused, or even against other defendants. If it seems necessary to file a case, it is possible to take the permission of the military court to request an additional charge against the accused or file a supplementary indictment against other persons.
(2) If a supplementary indictment is filed in accordance with sub-rule (1), such supplementary indictment shall be considered as an integral part of the indictment originally submitted.
(3) In accordance with sub-rule (1), if an accused is not satisfied with the additional charges against him, the accused may apply to the court hearing the appeal to have the charges quashed.
(4) If it appears that additional accusations of hazing or indecency have been made in accordance with this rule, the military court may order departmental action to be taken against the person making such additional accusations of hazing or infamy.
