Section 10
Punishment and confiscation

(1) If any person manufactures, keeps, uses, sells, transports or imports any of the following explosives without obtaining a license under section 4 or in contravention of section 5, he shall be liable to the following for each offence: Punishment shall be as follows:-

(a) nitroglycerin, dynamite, blasting powder or mercury or metal foil, imprisonment up to two years or fine up to twenty thousand rupees or both,

(b) Clause ( A) Explosive substances and explosives other than firecrackers and firecrackers, imprisonment up to 1 year or fine up to ten thousand rupees or both, (c) Fireworks or firecrackers fine up to one thousand rupees.

However, in case of punishment for the production, import or use of the same explosive substance, there will be no separate penalty for transportation if punishment is imposed for possession and importation, use or sale of that substance.

(2) If a person violates the conditions of the license taken under section 4 or violates the rules made under this Act, up to five thousand rupees in the case of clause (a) of sub-section (1), up to two thousand five hundred rupees in the case of clause (b). And in the case of clause (c), there will be a fine of up to five hundred rupees. Explanation: If the license expires and if the license does not give the right, action will be taken and the punishment will be considered as not having the license. (3) Clause Explosives related to offenses under 4 or 5 will be confiscated and will be taken to the Government of Nepal.
