Section 34
Penalty Punishment

(1) A person who acts in violation of paragraph-4 of this Act or in violation of the order under Section 25 shall be punished with imprisonment up to three years or a fine of up to twenty five thousand rupees or both.
(2) In case of improper use or misuse of medicine in contravention of section 18, or in contravention of section 29, if any person adulterates the medicine, or sells adulterated medicine, or sells any other thing as medicine, or sells and distributes expired medicine in contravention of section 30, or section 33 If he does any action contrary to this, he will be punished as follows:-
(a) In case of death due to the consumption of such medicine, up to life imprisonment according to the amount of the crime,
(b) If there is a risk of death due to the consumption of such medicine, or if there is a possibility of death, it is the same as committing an act of killing,
(c) Imprisonment for up to ten years and fine up to one lakh rupees, if the strength of any limb of the body may be weakened or lost due to consumption of such medicine,
(d) Imprisonment up to five years and fine up to fifty thousand rupees in cases other than clauses (a), (b) or (c).
(3) Apart from what is written in sub-section (1) and (2), a person who commits any act in violation of this Act or the rules made under this Act shall be punished with imprisonment up to one year or a fine of up to five thousand rupees or both.
(4) In case of death or dismemberment or any other loss, loss or damage due to the commission of an offense under this Act, the offender shall pay reasonable compensation to the victim and in case of his death to his rightful person.
